.HIGH COURT OF DELHI In W.P.(C) 3035/2016 RAM PHAL versus UNION OF INDIA & ORS August 03, 2016 ruled that a Subedar Major retired from scale RS. 6500-10500 on July 31, 2002 from CPMF is entitled for Pension Rs. 9375 in VI PC, since post of Subedar Major was put in PB2 Rs. 9300-34800 with GP Rs. 4800, as reflected in Section II of Part C of Revised pay structure for certain posts in Ministries and UT as notified in Gazette of India. H.C. said since OM 11 Feb 2009 is quashed by CAT/PB and endorsed by Delhi H.C. in S29 case, benefit of upgraded post cannot be denied to pre 2006 pensioners.
