Subject: Clarification w.r.t. the sub categories listed under clause a,b,c & d for recruiting the post of Postal Assistant/Sorting Assistant – Reference from Departments of Posts

The undersigned is directed to refer to Ministry of Communication’s ID note F. No, SC- 12/6/2022-SCT-DOP on the subject mentioned above and to Say that this Department on 4th January, 2021 notified the list post (Group A,B,C and D) identified suitable for Persons with benchmark disabilities covered under Section 34(1) of the RPwD Act, 2016. As per Note-6 of (the said notification, it has been made clear that the list will be the principal list in respect of the posts identified suitable for persons with benchmark disabilities. However, in case a list of post is separately identified by any Central Government establishment, the list having wider range of identified categories (i.e, having more sub-categories under each Category) would prevail. Department of Post has sought clarification of this Department to deal with cases where the list notified by individual Ministry or Department has wider range of disabilities in one Category and the list notified by this Department On 4.1.2021 has wider range under other Category.

2. The issue has been examined and it is clarified that in such a situation, the individual Ministry and Department may follow the combined list involving both DEPWD notification dated 4.1.2021 and list notified by them so as to cover al] Sub-categories of benchmark disabilities under Clauses (a,b,c,d) as notified in both the lists. For example:

(a) whether the Government is considering to make provision of creamy layer in the general category for Government services on the lines of provision of creamy layer for the candidates in Other Backward Classes (OBCs) so that only weaker sections get benefits in Government services and if so, the details thereof?

(b) whether a dual policy is being implemented on the candidates belonging to OBCs by implementing the provision of a creamy layer only on Other Backward Classes;

(c) the details of income criteria set for creamy layer at present including the time of its increase; and

(d) whether it is being increased from time to time and if so, the details thereof?

(a) & (b): The concept of exclusion of creamy layer from amongst Other Backward Classes (OBCs) has been introduced based on the directions of the Hon’ble Supreme Court in Indra Sawhnay Vs. UOI & Ors delivered in 1992.

(c) & (d): The Income criteria to exclude creamy layer has been revised from time to time as follows:

(i) Vide O.M. No. 36033/3/2004-Estt.(Res), dated 9th March, 2004, the income limit was revised from 1 lakh to Rs. 2.5 lakh per annum.

(ii) Vide O.M. No. 36033/3/2004-Estt.(Res), dated 14th October, 2008, the income limit was revised from 2.5 lakh to Rs. 4.5 lakh per annum.

(iii) Vide O.M. No. 36033/1/2013-Estt.(Res), dated 27th May, 2013, the income limit was revised from 4.5 lakh to Rs. 6 lakh per annum.

(iv) Vide O.M. No. 36033/1/1/2013-Estt.(Res), dated 13th September, 2017, the income limit was revised from 6 lakh to Rs. 8 lakh per annum.

The present income limit is Rs. 8 lakh per annum.

(b) the number of Central Civil Service Officers who have either been removed or dismissed from service since 2017, State Cadre-wise data thereof; and

(c) the total number of vacancies currently existing in the Central Civil Service Officers, State cadre-wise thereof?

(a): Government employees may seek retirement from service by opting for voluntary retirement after completion of prescribed period of qualifying service under the respective applicable Rules viz. Central Civil Services (Pension) Rules, 2021, All India Services (Death Cum Retirement Benefits) Rules, 1958 etc. Government is also vested with the absolute power to pre-maturely retire the Government servants in public interest by invoking the provisions of respective service Rules/Fundamental Rule – 56 (j). As per the data uploaded by the different Ministries/Departments/Cadre Controlling Authorities (CCAs) on the Probity Portal maintained by the Department of Personnel & Training, during the period from July 2014 to June 2022 (as on 19.07.2022), FR 56(j)/similar provisions have been invoked against a total number of 203 Group-A and 192 Group- B Officers.

(b): In the matter of proven cases of grave misconduct, any penalty including removal or dismissal from service, as specified in the Central Civil Services (Classification, Control and Appeal) Rules, 1965, may be imposed on the Central Government employees to whom these rules are applicable. Since the charged officers are removed or dismissed under these Rules by the respective Cadre Controlling Authorities, data of such employees is not centrally maintained.

(c): As per the Annual Report of Pay Research Unit of the Department of Expenditure, the estimated total number of vacancies in Central Government Civilian Regular Employees as on 01.03.2021 is 9,79,327 against total sanctioned posts of 40,35,203.

(c) whether Government has come across any instances of hardship faced by pensioners while availing this technology in submitting “Life Certificate’ for availing pension; and

(a): Yes Sir. The Government has introduced Face Authentication Technology to submit ‘Life Certificate’ by Pensioners through the Jeevan Pramaan App with a view to enhance ‘ease of living’ for pensioners.

(b): Face Authentication Technology was launched by the Government on 29th November 2021 with a view to enhance ease of submission of Digital Life Certificate by pensioners. Department of Pension and Pensioners’ Welfare had collaborated with NIC, Ministry of Electronics and Information Technology (Meity) and UIDAI to utilize the ‘Face-Authentication Technology’ based on UIDAI Aadhaar software, for submission of digital life certificate by the Pensioners/Family Pensioners. As per this facility, the identity of a person is established through face authentication technique and it is now possible to submit Life Certificate using the Jeevan Pramaan App from any Android based smart phone and the Digital Life Certificate gets generated.

(c) & (d): The Government has not come across any instances of hardship faced by pensioners while availing this technology in submitting ‘Life Certificate’ for availing pension.

 DUTY OF COUNTER ASSISTANTS

It has been decided that the duty hours should be so fixed as to require the official attend office 15 minutes before the prescribed time to commencement of the counter. This will enable official to attend the transactions precisely at the time mentioned in the hours of business.

It is important to note that the change is not to make allowance for late attendance of counter Assistants, but in recognition of genuine practical problem and to render timely service to the customers. The purpose will be defeated if the counter Asst. delays his arrival at the office.

This arrangement is to be ensured by suitably costing the hours of attendance of officials. It is expected that this change will be effective every where by Sept. 1990. This is a standing instruction.

 TRAINING OF OFFICIALS SELECTED FOR APPOINTMENT AS POST-MAN VILLAGE POSTMAN

The allowance of Rs. 30 paid to the office Supervisors of divisional office for imparting training to each of new selected postman/Village postmen for a period of 10 days was increased to Rs. 50 vide DG(P) letter No. 103-9/83-SPB-II(Trg) dated 4-6-87.

The revision in the allowance has been further examined and it has now been enhanced the said allowance of Rs. 50/- to Rs. 100/- (One hundred only) for training of each batch of candidates with immediate effect.

This issued with the concurrence of FA (Postal) vide their No. 4670 dated 2-12-87.

 COMPULSORY REGISTRATION OF POSTAL ARTICLE

1.        Rule 66(1)(d) of Post Office Rules 1993 lays down what contents make the registration of a postal article obligatory Postage or other stamps or label or cheque, Hundi, Bank-note, Bank Post, Bill of Exchange or the like requires compulsory registration if the contents are either superscribed upon the cover or are known or manifest to the officers of the Post Offices owing to the transparency, insecurity, or insufficiency of the cover, or to any other cause.

2.        After a recent review/of the above provision, it has been decided to make the following changes in the rule;

i.         Dividend warrant, refund order, share certificate and debenture certificate also require compulsory registration.

ii.       The expression “or the like" appearing in the rule should be deleted.

iii.     Bank Post Bill' appearing among the contents requiring registration, should be deleted.

3.        These changes have been made by the amendment to the rule by notification no. CSR 420(E) dated 1-5-93 published in the Gazette Extraordinary dated May 18, 1993 a copy of which is attached with this letter. The amendment will be effective from 1st July 1993 and therefore, be brought to the notice of all post offices and Mail offices and officers concerned immediately for action.

4.        Correction slip to clause 17(d) of P.O. Guide Part 1 (1985) edition is also enclosed.

5.         Rule 66(1) (d) continues to stipulate that registration of mail with the specified contents is obligatory only if the con-tent is either superscribed on the cover or is known or manifest to the office of the post office owing to the transparency, insecurity or insufficiency of the cover or to any other cause.

(a): In pursuance of Hon’ble Supreme Court judgment dated 28.1.2022 in the matter of Jarnail Singh and Ors. VLachhmiNarain Gupta and Ors., Department of Personnel and Training has issued an Office Memorandum No.36012/16/2019-Estt(Res) dated 12.04.2022, advising all the Ministries/Departments of the Central Government to comply with certain conditions before implementing the policy of reservation in promotion which, inter alia, include collection of quantifiable data regarding inadequacy of representation of Scheduled Castes (SCs) and Scheduled Tribes (STs) and application of this data to each cadre separately.

(b): DoPT collects data regarding backlog reserved vacancies of SCs and STs from 10 Ministries/Departments, having more than 90% of the employees in Central Government and monitors the progress with regard to filling up of these backlog reserved vacancies. The data on backlog reserved vacancies in the above 10 Ministries and Departments as on 1.1.2021 is at Annexure.

(c) & (d): Achieving progress on the issue of affirmative action, is through voluntary action by the industry itself. Industry representatives are also of the view that reservation is not a solution but they are willing to partner with the Government and appropriate agencies in enhancing and expanding the current recruitment policy for the marginalized . section, especially the SC and ST at all levels, as also to encourage skill development and training.

Accordingly, the Apex Industry Associations have prepared Voluntary Code of Conduct (VCC) for their member companies centered around education, employability, entrepreneurship and employment to achieve inclusion. Measures undertaken by the member of industry Associations, inter-alia, includes scholarships, vocation training, entrepreneurship development programmes and coaching etc.

(a): Department of Personnel and Training (DoPT) monitors the progress in filling up of backlog reserved vacancies for Scheduled Castes (SCs), Scheduled Tribes (STs) and Other Backward Classes (OBCs) with ten Ministries/Departments, having more than 90% of the employees of Central Government. Ministry/Department-wise and category-wise (i.e. SCs, STs and OBCs) details of backlog reserved vacancies, as on 01.01.2021, are at Annexure.

(b) & (c): Filling up of vacancies, including backlog reserved vacancies, is a continuous process. Instructions have been issued to all Ministries/Departments of the Central Government to constitute an In-House Committee for identification of backlog reserved vacancies, to study the root cause of such vacancies, to initiate measures to remove the factors causing such vacancies and to fill them up through Special Recruitment Drives.
