MINUTES OF THE MEETING OF “INDIA POSTS’ RETIRED OFFICERS’ ASSOCIATION” DATED 21/12/2019.

The meeting of “India Posts’ Retired Officers’ Association” was held on Saturday the 21st December 2019 at 11.0 a. m. in the Conference Hall of Dadar Inspection Quarters (I.Q.) Dadar H.O. Building 5th floor Dadar (East) Mumbai 400014 under the Chairmanship of Shri R Ganesan Ex-Secretary to Government of India, Director General, Department of Posts India, New-Delhi-110001 and Hon’ble President of the Association.

The breakfast was served to the members before the meeting.
    3.   At the outset, two minutes’ silence was observed by the members in condolence of death of following Officers: -
       (i) Shri IMG Khan who was Ex Secretary DOP.
  (ii) Shri C.J Mathew Ex CPMG Maharashtra Circle
         (iii) Shri Baburaj Ex PMG Goa Region
         (iv)  Shri Narendra P.Munde Ex Supdt of POs Buldana Dn and an IPROA Member.
      4.    Shri S. P Sardal welcomed all attending members including President and Vice President present in the meeting. He also welcomed the outstation members who had come all the way from Pune, Jalgaon & Nagpur.
      5.    Smt Baby Rajgopalan Madam was felicitated with a flower bouquet at the hands of Shri R Ganesan Hon’ble President of the Association on her MBA in Human Resources.
       6.     Shri U.P.C. Tauro, Secretary of the Association informed all the members that the minutes of the last meeting held on 20th October 2018 at 11.0 a.m. at the Conference Hall of Dadar IQ, Dadar HO building 5th floor Dadar (East) Mumbai 400014 were circulated to all members through what’s app as well as through e mail & also posted in Associations’ Blog www.iproamh.com. Further the copies of the minutes were sent through post to the members not having what’s app and e mail. As such the minutes of the last meeting were got ratified unanimously.
        7.   While welcoming all members present in the meeting, Shri R Ganesan, President of the Association in his key note address, welcomed the outstation members who were outnumbering the local members. He showed his concern regarding the non-attendance of the Local Members. He also informed the gathering that due to his eyes’ Cataract Operations the meeting scheduled was postponed to this date. He also explained to the members the reasons why the decision was taken by the Executive Committee to wind up the “MH Circle Postal Veterans” what’s’ App group. He appreciated the commitment of Secretary IPROA in wishing the Officers on their Birthdays early in the mornings without fail. He also showed his concern that despite instructions some members are posting /forwarding political views in the official IPROA what’s app group. He also explained to the members the consequences of such postings which will ultimately put the admin of the Group in trouble. He further advised the gathering to enjoy life today & to forget what happened in the past.
      8.      Shri V K Khanna Vice President of the Association emphasized the need to be healthy.  For this he suggested regular exercise every day. For those who could not do regular exercises he suggested daily walk at least 10000 steps every day. He suggested that as the Postal Fraternity is financially in sound position now to avoid worries. He also suggested the members to maintain good health & feel good. He also suggested the members to take care of their heath and not to carry any burden with them. Let the past go. He advised the members to spend time with their children & grandchildren & to enjoy life & to keep travelling.  
    9.        The issue regarding granting the benefits of MACPS w.e.f.1.1.2006, as per Sixth CPC and Judgment of the Hon’ble Supreme Court was deliberated. It was informed to the gathering by the Secretary that DOP has issued instructions to all Chief Postmasters General on 22/11/2019 along with copy of Department of Personnel & Training Office Memorandum dated 01/11/2019 containing facts/grounds for defending the issue and to get the counter reply prepared and filed on the basis of the facts/grounds provided by the DoP&T as under.
              (i)  The matter is sub judice before the Hon’ble Supreme Court of India which has been filed by MOD against the order dated 14/02/2017 of Hon’ble High Court of Judicature at Madras.
              (ii) The Civilian & the PBOR personnel are governed by two different Resolutions.
            
               (iii) The Government had taken a decision for implementing the MACPS w.e.f.01/09/2008, the benefits of the existing ACP Scheme of August 1999, was allowed to the Government Servants up to 31/08/2008.
               (iv) It may be difficult to make recoveries from the employees who have availed higher financial benefit under ACP during 01/01/2006 to 31/08/2008 & retired from service.
               (v) The MACP is a condition of service and, hence, cannot be given retrospective effect.
              (vi) It is not feasible to extend the benefits of MACP during 01/01/2006 to 31/08/2008, as more than nine years of time has passed since the implementation of MACP. The change of effective date will lead to surge of litigation particularly from employees who availed the benefits of ACP Scheme during 01/01/2006 to 31/08/2008.
              (vii)  Hon’ble High Court of Judicature at Madras vide order dated 14/02/2017 has held that the benefit of erstwhile ACP Scheme cannot be negated by bringing a new scheme i.e. MACP with retrospective effect.
               This issue is also figuring in the charter of demands of the strike called by the Confederation of Central Government Employees and  workers on 08/01/2020
      10      Deliberations were held regarding Non-Functional Financial Upgradation in respect of Supdt of Post Offices from Level 8 (GP 4800) to Level 9 (GP 5400) after 4 years of Service in G.P.4800/-. It was informed to the gathering by the Secretary that DOP vide letter dated 08/11/2019 has called for the inputs/report from all Chief Postmasters General on the following points within a fortnight, so that the same may be taken up at appropriate level for further examination.
               (i) No of ASPOs/IPOs who have completed 4 years of service on or after 01/01/2006 in the G.P. of Rs 4800/-of PB 2nd or 7500 -12000 (pre revised) or in the corresponding revised Pay Matrix Level-8
               (ii)No of retired ASPOs/IPOs who had completed 4 years’ service on or after 01/01/2006 in the G.P. of Rs 4800/-of PB 2nd or 7500-12000 (pre revised) or in the corresponding revised Pay Matrix Level 8
               (iii) Total financial implications involved, if the benefits for granting Grade Pay Rs 5400/- in the 6th CPC or the corresponding Pay Matrix Level-9 in the 7th CPC is extended to the officers covering under (i) &(ii) above.
                It was further told by the Secretary that the above information is yet to be submitted by many circles including Maharashtra Circle despite 6 Reminders from Dte.
11         Discussion was held on fixation of Pay of IPOs/ASPOs in revised pay structure of 6th CPC consequent upon upgradation of Grade Pay of IPO Cadre from Rs 4200/- to Rs 4600/- w.e.f.01/01/2006 and fixation of Pay of IPOs/ASPOs in revised pay structure of 7th CPC as on 01/01/2016 who were granted 3rd financial upgradation in GP Rs 4800/- prior to 01/01/2016. It was informed to the gathering by the Secretary that as informed by DOP vide letter dated 22/08/2019, the DoP& T has issued Consolidated guidelines regarding Modified Assured Career Progressive Scheme (MACPS) for the Central Government Civilian Employees on 22/10/2019 incorporating the modalities for entitlements for MACP in case of upgradation of pay scales of certain posts by the 7th CPC.
          Para 6.1 of the O.M. dated 22/10/2019 of DoP& T and circulated by DOP on 30/10/2019 is reproduced as under: -
            “ In cases where financial upgradation had been granted to Government Servants in the next higher Grade Pay in the hierarchy of Grade Pays as per the provisions of the MACP Scheme of 19th May 2009, but whereas as a result of the implementation of Seventh CPCs recommendations, substantive post held by him in the hierarchy of the cadre has been upgraded by granting a higher Pay Level, in such cases the MACP already granted to him prior to 7th CPC shall be refixed in the revised pay structure at the next higher level of Pay Matrix. To illustrate, in the case of Postal Inspector (GP 4200/-in Department of Posts, who was granted 1st MACP in the Grade pay of Rs 4600/- in PB-2, he will now be granted (Grade Pay of Rs 4800/- in the pay band PB-2) Level 8 of the Pay Matrix consequent upon upgradation of the post of Postal Inspector from G.P. of Rs 4200 to GP of Rs 4600/-Level 7 in the Pay Matrix. However, all the financial upgradations under the Scheme should be done strictly in accordance with the hierarchy of Levels in the Pay Matrix as notified vide CCS (Revised Pay) Rules, 2016” It was further informed by the Secretary that both the above issues have been taken up by the General Secretary Postal Officers Association with Shri P. K .Bisoi  Secretary Posts on 13/11/2019  to issue clear orders on the matter so that all may get justice.     
12.  Deliberations were held regarding one notional increment to the pensioners retired                                           on 31st December and 30th June. It was informed to the house by the Secretary that to the question raised in the Rajya Sabha on this subject it was replied by Dr Jitendra Singh Hon’ble MOS PMO that “as the judgement is in personam and is contrary to the personnel policy of Government of India, no general order has been issued. It was further told by the Secretary that this issue has been taken up by Shri S.C. Maheshwari Secretary Bharat Pensioners’ Samaj on 09/12/2019 with Dr Jitendra Singh Hon’ble MOS PMO to prevail upon Do P&T / DOPPW to re-examine the matter with a serious thought in the light of advice rendered by the S.C read with the advice of Hon’ble P.M. and issue instructions to pass orders for application of the said judgement to all similarly placed Pensioners and save them from further litigation.
13.      Regarding the strike dated 8th January 2020 it was informed to the gathering by the Secretary that in the 10 points Charter of Demands of Confederation of Central Government Employees and  workers 02 issues pertaining to the members have been taken up. (I ) Grant Promotional hierarchy and date of effect from 01/01/2006 , (ii) Grant option I  parity recommended  by the 7th CPC to all Central Govt Pensioners. The Secretary explained that 7th CPC has recommended a new formula called “Option I “for refixing the existing pension of Central Government Pensioners retired prior to 01/01/2016.Government accepted the recommendation in principle and constituted a Secretary Level Committee to examine and recommend regarding the feasibility of implementing “Option I “recommended by 7th CPC. The Committee was not ready to heed the valid and scientific pleadings made by the staff side in favour of the recommendation made by the 7th CPC which is an “Expert Body” headed by retired Justice of Supreme Court. Instead viewed the case with a closed mind and gave recommendation to the Government that implementation of “Option I “is not feasible. Govt accepted the recommendations of the Secretary Level Committee and rejected “Option I “recommended by 7th CPC.
            The 7th CPC. vide para no 10.1.67 (i) had recommended all civilian personnel who retired prior to 01/01/2016 shall first be fixed in the Pay Matrix being recommended by this commission, on the basis of the Pay Band and Grade Pay at which they retired, at the minimum of the corresponding level in minimum of the corresponding level in the matrix. This amount shall be raised, to arrive at the notional pay of the retiree, by adding the number of increments he/she had earned in that level while in service, at the rate of 3 percent. Fifty percent of the total amount so arrived at shall be the revised pension    
14.       Regarding implementation of Government’s decision on the recommendation of the Sixth Central Pay Commission – Revision of provisions regulating pension /family pension it was explained by the Secretary that as per orders of Ministry of Personnel, Public Grievances & Pensions, Dept of Pension& Pensioner’s Welfare dated 2nd September 2008, the linkage of pension with 33 years qualifying service has been dispensed with. The pension shall be paid at 50% of the emolument or average emoluments received during the last 10 months, whichever is more beneficial to him. The minimum pension is Rs 9000/- as per 7th CPC & maximum upto 50% of highest pay in the Government.
            The Quantum of pension available to the old pensioners shall be increased as follows: -

From 90 years to less than 95 years
40% of basic Pension
From 95 years to less than 100 years

           The Pension Sanctioning Authorities should ensure that the date of birth and the age of the pensioner/family pensioner is invariably indicated in the PPO to facilitate payment of additional Pension/Family Pension by the Pension Disbursing Authority as soon as it becomes due.
         The Quantum of family pension available to the old family pensioners shall be increased as follows:

15.        In respect of India Post Payment Bank, Linking of POSA Accounts to IPPB, Major changes in SB Rulings w.e.f 12/12/2019, SB Order 13/2009 dated 18/12/19 New fees for all schemes & Govt Savings Promotion General Rules 2018 Schedule-II the Secretary requested the members to go through the broachers distributed to them along with the Minute to Minute Programme.
16.    The issue regarding the subscription received from members of IPROA who are deceased was discussed. As at this stage nothing could be done and the amount of subscription collected from these deceased members is meagre it was unanimously decided to continue to show the amount of subscription in their names.
      17.   The outstanding subscription was deliberated. It was requested by the Secretary to all members to ensure up to date payment of Annual Subscription upto March 2020. Regarding action to be taken in respect of members who have not paid Registration fee & 3 years’ subscription, since non-payment of 3 years’ subscription amounts to cessation of membership it was decided to remove them from IPROA Membership duly intimating them & to re-join them when all the dues are paid. It was informed by the Secretary to the gathering that out of 25 members removed from IPROA Membership 02 have joined back depositing all the dues.     
      18.     The issue regarding the Life Membership was deliberated. It was pointed out by Hon’ble President of the Association that though there is a clause in the Bye-Laws of the Association since the IPROA is yet to be Registered it was suggested by him to await to avail this facility till the Registration of the Association.
      19.     Regarding the action plan for the Outstation Members the Secretary informed the house as already discussed Local meetings at Regional Level can be held within the purview of Bye-Laws of the Association.
    20.     The Hon’ble President requested the gathering to enrol more members by contacting the remaining Local Retired Gazetted Officers’ of India Posts including the Voluntary Retired Officers. The Regional Secretaries were requested to contact the remaining Retired Gazetted Officers’ of India Posts and enrol them as IPROA Members. Shri Edwin Amburaj Jt Secretary informed the gathering that he had contacted 03 recently Retired Officers. Only one had responded with “not interested”. There is no response from other 02 members.
  21.       It was suggested by Shri P.G. Ghate to book the I.Q. Dadar from one day in advance of the meeting so that the outstation members can come one day in advance for the meetings. This was unanimously agreed & Secretary assured that this will be ensured for the next AGM to be held in June 2020.
  22.        It was suggested by   Shri P.R. Meshram to hold the meetings on 2nd or 4th Saturdays as there will be less rush in the local trains. Secretary informed that this is being ensured. But for the days meeting the Hon’ble President had already given his clarification in the key note address. 
  22.       It was also suggested by Shri P.G. Ghate to give a small gift to the members attending the AGM with the IPROA with logo printed on it as a memento. The Hon’ble President agreed with the condition that if the financial position of the Association permits. The Secretary assured that if the members pay their subscription of the year 2020-2021 in advance before May 2020 the Executive Committee of the Association will be in a position to discuss & approve the issue.
23.      Next meeting of the Association was proposed to be 5th Annual General Body Meeting proposed to be held on Saturday the 13th June 2020, at 11.0 am in the Conference Hall of Dadar Inspection Quarters (I.Q.) Dadar H.O. Building 5th floor Dadar (East) Mumbai 400014 under the Chairmanship of Shri R Ganesan Ex-Secretary Posts followed by Lunch. Hence the outstation members were requested to book their tickets in advance and attend in large numbers without excuse of non-availability of ticket.
24.   Shri P.G Karne rejuvenated all the attending members by the clapping exercise as well as laughter session. He also gave a talk on water therapy as well as on healthy food habits which was appreciated by all the attending members.
        Delicious lunch was served to the members after the meeting with kulfi slice
